Welcome to the PROBE mobile app, shop and hardware! When you access, sign up or use our services and products, you're agreeing to follow the terms below.

General

These terms and conditions govern you as a consumer (private person) and your use of the PROBE mobile app, shop, and hardware provided by Djup AB, trading under the brand PROBE Fishing.

By signing up, accessing or using our services, you signify that you have read, understood and agree to be bound by these Terms and Conditions. We reserve the right to modify these Terms and Conditions at any time. For the latest version of these Terms and Conditions please visit www.probefishing.com/tc. You are responsible for making sure you adhere to the latest version of these Terms and Conditions. You also agree that you are thirteen (13) years of age or above - no one under 13 may sign up, buy or use the Services.

Access 

You can download the PROBE app from app stores, install it on your phone, and use it. You can view and download content from the app for personal use only. To access information about your lure's journey underwater: swimming depth, water temperature, cast length and more you need to have both the PROBE app and hardware. PROBE (hardware) is a gadget that is attached in front of the lure and contains sensors that records fishing data.

Other Services 

We might offer additional services through our app. If you use these services, make sure it's just for yourself and not for anyone else.

Compatibility 

The PROBE app is compatible with iOS and Android, although the app may not work on every device, model or OS version. You're responsible for making sure you have a device that is compatible with the required version.

User Accounts 

You might need to create an account to use certain parts of the app. Keep your account details safe, and let us know if you notice any suspicious activity.

User Responsibilities 

You agree to use the app responsibly, follow the law, and not do anything harmful or deceptive.

You agree to show respect for the fishes you catch, catch and release is preferable.

Changes and Suspension 

We can change or suspend parts of the app at any time. User accounts can be revoked if misuse is detected. 

Intellectual Property

The app and its content belong to us or our partners. Don't use them without permission.

App Updates 

You might get updates for the app from us. You might need to agree to new terms to keep using the app.

Privacy

We only use your personal data and the data recorded through PROBE and it’s app when we have a good reason to, and the law allows it. Here's when, why and how we use it: 

We collect and store data recorded by the PROBE hardware and the app (PROBE data). The PROBE data is intellectual property owned by Djup AB. We intend to use it, and in anonymized format share it with companies and organizations who can benefit from the data in combating climate change, or observing and addressing man-made environmental degradation or to protect water environments and water living species.

We collect your fishing data recorded in the app. We might share your recorded data in aggregated form with companies and organizations that can use it in the job of combating climate change, or observing and addressing man-made environmental degradation.

When you provide personal data to us directly, like when you sign up on our website or app, order something, or contact us. When you use our app or website, we automatically collect some info, like your IP address. Sometimes, we get info from other sources, like public records or our partners. If someone else gives us your info with your permission, we'll use it too. To use some of the features in the app you need to give us permission to use device bluetooth, geolocation, camera and camera roll. You're responsible for making sure the info you give us is correct and up to date. If we ask, you might need to prove you have the right to give us someone else's info.

When you sign up using Google Sign in or Sign in with Apple we store your email address.

Safety 

Don't try to mess with the app or hardware or do anything that could harm them.

Third-Party Websites 

We might link to other websites, but we're not responsible for them. Use them at your own risk.

Push Alerts 

We might send you notifications through the app. You can turn these off in your settings.

Advertising

Our app might show advertising or partner offerings.

Third-Party Software 

If our app includes software from other companies, their terms also apply.

Warranties

We try our best to keep the app accurate, but we can't guarantee everything is perfect.

Limitation of Liability

We're not responsible for any damages you might experience from using PROBE (hardware) and the PROBE app.

We are not responsible nor liable for any direct, indirect, incidental or consequential damages relating in any way to the use of our Services or Products. We shall not under any circumstances be liable for any damages in excess of the amount of your purchase price of one PROBE.

PROBE Shop

The PROBE Shop at https://www.probefishing.com/ sells our hardware and related items. 

Purchase Agreement

When making a purchase on our website you are aware of the product’s technical specifications mentioned on our website. A purchase agreement is established between you and Djup AB upon receiving an order confirmation, serving as your receipt.

Customer Service

For inquiries or concerns about our products, please contact our customer support at tuned@probefishing.com. Prior to returning any product, please contact customer service.

Prices and Payment

All prices and payment options are available on our website. We reserve the right to withhold an order until payment is processed and approved.

Order Changes

Once an order is confirmed, modifications cannot be made to the selected items.

Delivery

All orders are shipped from our warehouse in Sweden. Shipping confirmation will be emailed upon shipment.

Right of Withdrawal

You have the right to withdraw your order within 14 days from receiving the product. Products must be returned in original condition within this period.

Warranty

PROBE Fishing warrants that products are free from manufacturing defects for 24 months from the date of delivery.

Complaints

If you receive a damaged or defective product, lodge a complaint via email within two months of discovery. Do not send items for repair without contacting customer service first.

Privacy

We assume responsibility for all personal information provided during purchases. Refer to our privacy policy for details on data processing.

Applicable Law and Disputes

These terms and conditions are governed by Swedish law. Any disputes shall be settled by arbitration or Swedish public court.

You can return products within 30 days for a refund if they're eligible. Products must be returned unused with original packaging and instructions. Refunds will be made through your original payment method.

Governing Law

These Terms and Conditions shall be construed in accordance with and governed by the laws of Sweden. Any dispute, controversy or claim arising out of or in connection with these Terms and Conditions, or the breach, termination or invalidity thereof, shall be finally settled by arbitration in accordance with the Rules for Expedited Arbitrations of the Arbitration Institute of the Stockholm Chamber of Commerce. The seat of arbitration shall be Stockholm. The language to be used in the arbitral proceedings shall be Swedish.
